Penalties and sanctions when staying in Kazakhstan with expired visa



A foreigner did not leave Kazakhstan in time. For example, his visa expired. What fines/sanctions are provided for this? 

If a foreigner does not leave on time, the following measures are applied: 

  1. Within 3 days after the deadline — a warning. 
  2. Over 3 to 5 days after the deadline — imposition of a fine of 10 minimum wages (MRP), which is 34,500 tenge. 
  3. Over 5 to 10 days after the deadline — imposition of a fine in the amount of 15 MRP, which is 51,700 tenge. 
  4. Over 10 days after the expiry of the prescribed period — imposition of a fine of 25 MRP, which is 86,250 tenge, or administrative expulsion of the alien from the country. 

If a foreigner commits a repeated violation within a year, the court may apply the following measures: 

  1. Imposition of a fine of 15 MRP, which is 51,700 tenge, or administrative expulsion of the foreigner from Kazakhstan. 
  2. Arrest for up to 15 days followed by administrative expulsion from Kazakhstan.
  3. Prohibition to enter the country for up to 5 years. 

Please note that these sanctions apply to foreigners who are in Kazakhstan with an expired visa or period of stay.
